I have been hearing from a LOT recently that more SCAM BOOK SITES are appearing online in ever increasing numbers…
What can YOU do about it?
If you are an author and YOUR book(s) are being offered without your permission – issue DMCA Notices (SEE BELOW FIRST)
If you are a reader – PLEASE DO NOT USE THESE SITES!
It may be tempting to get books FOR FREE or at greatly reduced prices but…
They may be a click farm looking for your email
and you will be infected with a virus.
*****
AUTHORS – VERY IMPORTANT!!!
DO NOT SEND THE OFFENDING SITE A DIRECT NOTICE.
If they are on Facebook – Use Facebook’s reporting form to remove their link source from Facebook’s server.
My attorney warns me not to click on them, but to send a form letter to their server.
You can find out their server here: http://www.whois.com/whois/
A copy of the take down form letter to send:
SAMPLE DMCA TAKE DOWN NOTICE
My name is INSERT NAME and I am the INSERT TITLE of INSERT COMPANY NAME.
A website that your company hosts (according to WHOIS information) is infringing on at least one copyright owned by my company.
An article was copied onto your servers without permission.
The original ARTICLE/PHOTO, to which we own the exclusive copyrights, can be found at:

The unauthorized and infringing copy can be found at:
PROVIDE WEBSITE URL
This letter is official notification under Section 512(c) of the Digital Millennium Copyright Act (”DMCA”), and I seek the removal of the aforementioned infringing material from your servers. I request that you immediately notify the infringer of this notice and inform them of their duty to remove the infringing material immediately, and notify them to cease any further posting of infringing material to your server in the future.
Please also be advised that law requires you, as a service provider, to remove or disable access to the infringing materials upon receiving this notice. Under US law a service provider, such as yourself, enjoys immunity from a copyright lawsuit provided that you act with deliberate speed to investigate and rectify ongoing copyright infringement. If service providers do not investigate and remove or disable the infringing material this immunity is lost. Therefore, in order for you to remain immune from a copyright infringement action you will need to investigate and ultimately remove or otherwise disable the infringing material from your servers with all due speed should the direct infringer, your client, not comply immediately.
I am providing this notice in good faith and with the reasonable belief that rights my company owns are being infringed. Under penalty of perjury I certify that the information contained in the notification is both true and accurate, and I have the authority to act on behalf of the owner of the copyright(s) involved.
Should you wish to discuss this with me please contact me directly.
Thank you.

I agree with much of what you say except for the public shaming part. Public shaming can destroy a persons life (for the rest of their life) and to me that is not a suitable punishment for the crime. I’ve been on the wrong end of internet bullying and I know all to well the effect mass attacks can have on someone both privately and publically. Also in most cases public shaming of plagiarism and copyright infringement occurs without any evidence other than word against word. I have never seen a shaming campaign where the person accusing someone of infringement provides tangible proof that they indeed hold the copyright, Word against word degenerates into a Salem Witch Hunt effect.
I have had my own words lifted also. I have not pursued legal action. It is an expensive process with un-determinable results. Copyright law is a very tricky thing. For example if you produce a book of poetry, copyright the book, the individual pieces must also each have a copyright to be protected, the book’s copyright only protects the whole and not the parts that actually make up the whole and a Haiku could be argued to be too short to receive copyright as you cannot copyright a word, a sentence, or a saying. Nor can you copyright an idea, yet I hear people claim copyright infringement saying someone stole their idea (even though the idea was expressed with different words.)

The issue here is not the stealing of ideas, it’s the stealing of books, reputations, hard work, years of dedicated time to write and produce books and possibly even livelihoods.

yes I understand. My books also appear on a couple of these websites without my permission, I’ve also had entire pieces of poetry lifted word for word and credited to some one other than me, but as I am currently offering my books for free digitally and as they are offering them for free also it does not make sense to pursue legal action… also I am safe in the knowledge my voice is quite distinct and would be hard for anyone to duplicate on a consistent basis while being as prolific as I am.
I just don’t see internet fights (shaming) as a way to go…for example what if someone came to you to say I have stolen their book of poetry, but I haven’t and perhaps I had no knowledge they had stolen my words. A public shaming campaign begins my name would hence be sullied and the plagiarizer would receive the support of the masses. Even if at that point I took legal action to restore my name the damage has been done and in most cases public opinion has been formed and will remain as it was regardless the verdict. All I’m saying is Mob Mentality usually gets things wrong in the rush to rectify a perceived wrong.
My apologies Chris. I’m not trying to argue, just trying to shine light on another perspective. Also I wouldn’t wish on anyone what I had to endure from Dec. 2013- May 2014 over what was nothing more than a difference of opinion which a large blogger who took exception to my argument. Public shaming of individuals is a form of bullying. I do feel public shaming is useful against large entities such as governments and corporations, but in the case of the individual it ruins lives and I’ll leave it at that.

That’s why, in my article I state:
AUTHORS PLEASE NOTE – If YOU come across any such sites and are CERTAIN they are infringing YOUR copyright.
I don’t agree with mob rule either, but I DO believe every author should be aware of issues like this and have the courage to stand against them.

This is a very important message from Chris The Story Reading Ape about those piracy sites we’ve been discovering online – they’re not about piracy and stealing our intellectual property! Here’s what you can and should do, as an author or a reader, to help get rid of them, for good!

Thanks for spreading the word again, Chris. Eventually … I hope these sites will be shut down.

I doubt they will ever go away Susan – all we can do is tackle them as they’re found 😦
